COOK V ELECTRIC LIGHT AND POWER SUPPLY CORPORATION, LTD.
This was an action brought by John Joseph James Cook against the Electric Light and Power Supply Corporation, Ltd, for damages for injuries received on May 5, 1939, when he came in contact with an uninsulated wire leading to a house in Old Canterbury Road Summer Hill, which the plaintiff was in process oí painting. He received a shock which threw him to the ground, injuring his back.
The defendant company denied liability.
The taking of evidence had, not concluded when the Court lose till this morning.

VERDICT FOR DEFENDANT
By his Honor's direction, the jury gave a verdict for the defendant in the action by John Joseph James Cook against the Electric Light and Power Supply corporation Ltd., to recover damages for injuries suffered by Cook on May 5, 1939, through his contact with an uninsulated wire leading to a house in Old Canterbury Road, Summer Hill which he was in process of painting.
The defendant denied liability.
His Honor rules that the case was governed by section 38 of the Balmain Electric Lighting Act, of 1906. and that the defendant company enjoyed certain protection in respect of actions that might be brought under that Act.

Narrative
A real gentleman, of slim build, 5"9" tall, he played the piano beautifully. Born in 1879, he died Sydney 1955, aged 76.
John James Joseph met Celia Rose FRANKLIN when visiting a friend. Celcia Rose FRANKLIN 1882-1958, Ist daughter born Australia to Eliza and James FRANKLIN.
His varied occupations were; a conductor on the Railwy, Clerk on the Railway, coach and general painter, mail coach driver and nurse at Gundagai hospital. He is remebered by this trade, he passed them on to son, William John Franklin. The birhts of J J J and Celina Rose, children placed them in Canowindra, in a house called SPINE CORP on the Cowra Road c. 1908, then at Parkes 1910-1917 and on to Sydney for the great 1917 Railway strike period: HIlton being born in Dulwich Hill. Celcia Roses has been reported as being the granddaughter of Sir Benjamin FRANKLIN. Her family of Eliaz and James Franklin came to Australia from Staffordshire U.K.
