EJECTMENT ORDER REFUSED
PREMISES IN CAIRNS.
An application brought by Mary Ellen Sidey, of Innisfail, for an ejectment order against Mrs. Rena Louisa O'Rourke from premises at 29 Archie-street, was refused by Mr. E. D. Smart, S.M., in the Cairns Summons Court yesterday. Mr A. T. Covacevich appeared for Mrs. O'Rourke, Mr. H. Eric Dann for the applicant. Evidence was given by Mrs. Fanny Elisa Sidey (mother of the applicant) and by Mrs. O'Rourke.
Mrs. Sidey stated she had previously resided at the subject premises but had been living with her daughter in Innisfail since September, 1939. She had gone to Innisfail, because of threatening war conditions, and her daughter now desired the premises in Archie street for her (Mrs. Sidey's) use The Innisfail premises were very small.
Mrs. O'Rouke said that she had resided in the subject premises for four and a half years. She had four children residing with her, and her two nephews intended to stay permanently with her. Two of the elder children contributed to the upkeep of the home, and she also worked.
Some years ago she had refused an offer of a house in English street made by Miss Sidey, because it was too far out. The youngest child was then only a baby and she wished then to remain close to the city for reasons connected with her work. She had been looking for a larger house and if offered suitable premises would vacate.the subject premises.
